1. About GuestPass
GuestPass is a visitor-management platform that helps residential communities, businesses and other facilities securely record, manage and analyse visitor activity.
2. Eligibility
You must be at least 18 years old to use the Services. By using GuestPass you confirm you meet this requirement and that any information you provide is accurate and complete.
3. Account Registration
Certain features require an account (e.g., guard or admin login). You are responsible for safeguarding your credentials and all activity under your account. GuestPass may suspend or terminate accounts that violate these Terms.
4. Acceptable Use
- Interfere with or disrupt the platform or its security measures;
- Attempt unauthorised access to any part of the Service;
- Upload or transmit malicious code, content or files;
- Use the Service for unlawful, harmful or fraudulent purposes.
5. Data Usage & Privacy
Our Privacy Policy explains what data we collect, why we collect it, and how it is protected. By using the Service you acknowledge and agree to that policy.
- Visitor data (name, phone, ID, photo, purpose) is stored securely on GuestPass servers for audit and analytics.
- Ephemeral data such as on-device OCR scans is processed only in memory and discarded immediately after use.
- No data is sold or shared with advertisers. Limited sharing occurs only with the resident being visited or the facility’s authorised administrators.
6. Intellectual Property
All software, content and trademarks on the platform are owned by GuestPass or its licensors. You may not copy, modify, distribute or reverse-engineer any part of the Service without our prior written consent.
7. Third-Party Services
The Service may integrate third-party tools such as SMS gateways or e-mail providers. GuestPass is not responsible for the content or practices of third-party services, which are governed by their own terms.
8. Service Availability
We aim for high availability but do not guarantee uninterrupted or error-free Service. Scheduled maintenance or technical issues may result in temporary downtime.
9. Account Termination / Deletion
GuestPass may suspend or terminate your account for breach of these Terms or misuse of the Service. You may delete your own account at any time by visiting our Account-Deletion page and following the on-screen steps. Deletion permanently removes your credentials and associated visitor logs, except for minimal audit records retained for up to 30 days to meet legal or security requirements.
10. Limitation of Liability
To the maximum extent permitted by applicable law, GuestPass will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits or data arising from your use of the Service.
11. Changes to These Terms
We may update these Terms periodically. We will post the revised Terms on this page and update the “Effective Date”. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
12. Governing Law
These Terms are governed by and construed in accordance with the laws of Kenya. Any dispute arising from these Terms shall be resolved exclusively in the courts of Kenya, unless otherwise agreed in writing.
